D1A’s Statement On President Trump’s Rescission Of Biden Administration Executive Order

The Day 1 Alliance (D1A), the trade association representing private-sector criminal justice and immigration system contractors, released the following statement from National Spokesperson Alexandra Wilkes on President Donald J. Trump’s rescission of Executive Order 14006, “Reforming Our Incarceration System To Eliminate the Use of Privately Operated Criminal Detention Facilities.” Members of the Day 1 Alliance include CoreCivic, The GEO Group (GEO), Management & Training Corporation (MTC), and LaSalle Corrections.

“The Biden Administration’s Executive Order was a misguided attempt to blame longtime government contractors for a ‘mass incarceration’ problem that they play zero role in driving. In reality, contractors have been a limited but valued part of the solution to serious challenges facing the U.S. criminal justice system, providing flexible, cost-effective solutions to our government partners for decades – under both Democratic and Republican administrations.  

The now-rescinded Executive Order was based on multiple falsehoods about the work of that contractors do. Below are some facts to help set the record straight:

    • Just 8% of incarcerated individuals nationally are cared for in facilities operated by contractors. 
    • Contractors are subject to multiple layers of oversight and accountability, as well as standards set by Congress, regular audits and visits by federal and state regulators, Members of Congress, and other stakeholders. 
    • Contractors do not lobby on any policies, regulations or legislation that impact the basis for or duration of an individual’s incarceration or detention. 
    • Numerous independent studies and audits have found contractor facilities to be equal or better than public sector facilities with regard to safety and quality. 
    • Every day, contractors deliver educational, vocational, substance abuse, and life skills training to thousands of incarcerated men and women, helping prepare them to successfully transition back into society upon their release.”
